Le document de consultation pose un certain nombre de questions relatives au taux d&rsquo;int\u00e9r\u00eat criminel et \u00e0 l&rsquo;impact des pr\u00eats \u00e0 temp\u00e9rament \u00e0 co\u00fbt \u00e9lev\u00e9. La consultation ne porte pas sur les pr\u00eats sur salaire, qui sont r\u00e9glement\u00e9s au niveau provincial. Les questions portent notamment sur le fait de savoir si les taux d&rsquo;int\u00e9r\u00eat fix\u00e9s par les pr\u00eateurs alternatifs \u00e0 co\u00fbt \u00e9lev\u00e9 refl\u00e8tent le risque de cr\u00e9dit de l&#8217;emprunteur ou s&rsquo;ils sont fix\u00e9s pour respecter les plafonds de taux d&rsquo;int\u00e9r\u00eat, ainsi que sur l&rsquo;impact d&rsquo;une baisse du taux sur l&rsquo;acc\u00e8s au cr\u00e9dit. Le Conseil canadien des responsables de la r\u00e9glementation d&rsquo;assurance (CCRRA) et les Organismes de r\u00e9glementation des services d&rsquo;assurance du Canada (CISRO) m\u00e8nent des consultations sur les pr\u00e9occupations qu&rsquo;ils ont concernant les commissions initiales utilis\u00e9es dans la vente de fonds distincts et de contrats individuels \u00e0 capital variable (CICV). Plus t\u00f4t cette ann\u00e9e, le CCRRA et les CISRO ont d\u00e9j\u00e0 d\u00e9clar\u00e9 que l&rsquo;utilisation des frais d&rsquo;acquisition diff\u00e9r\u00e9s (FAD) dans les ventes de contrats de fonds distincts devrait cesser compl\u00e8tement d&rsquo;ici le 1er juin 2023. Le document de consultation souligne que les commissions initiales dans la vente de fonds distincts cr\u00e9ent des probl\u00e8mes potentiels li\u00e9s aux conflits d&rsquo;int\u00e9r\u00eats lorsque les consommateurs comptent sur les conseillers pour leur vendre un produit appropri\u00e9 et que le conseiller est pay\u00e9 par l&rsquo;assureur pour la vente et le service de ces produits. L&rsquo;objectif principal de la consultation est de mieux comprendre les modalit\u00e9s de r\u00e9mun\u00e9ration des fonds distincts et des CICV, et de d\u00e9terminer les changements \u00e0 apporter \u00e0 la r\u00e9mun\u00e9ration initiale afin d&rsquo;am\u00e9liorer les r\u00e9sultats pour les clients. Un certain nombre de r\u00e9sultats cibl\u00e9s pour les clients sont d\u00e9crits dans la consultation, y compris une approche r\u00e9glementaire qui aborde efficacement les conflits cr\u00e9\u00e9s par la r\u00e9mun\u00e9ration initiale qui peut d\u00e9saligner les int\u00e9r\u00eats des assureurs, des interm\u00e9diaires et des clients, am\u00e9liorer la sensibilisation des clients \u00e0 la r\u00e9mun\u00e9ration des interm\u00e9diaires et r\u00e9duire les risques de vente erron\u00e9e de fonds distincts et de CICV par rapport aux produits de valeurs mobili\u00e8res par des interm\u00e9diaires titulaires d&rsquo;une double licence en raison des diff\u00e9rentes modalit\u00e9s de r\u00e9mun\u00e9ration initiale.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Aper\u00e7u des commentaires du Conseil :<\/h2>\n\n\n\n<p>Le Conseil soutient fermement les initiatives visant \u00e0 accro\u00eetre la transparence des co\u00fbts et des frais dans la vente de produits d&rsquo;assurance. Nous soutenons l&rsquo;interdiction des frais d&rsquo;acquisition diff\u00e9r\u00e9s (FAD) dans les ventes de fonds distincts et nous croyons que les deux structures de commissions initiales (FAD et r\u00e9trofacturation du conseiller) devraient \u00eatre interdites en raison des conflits insolubles qu&rsquo;elles cr\u00e9ent entre les interm\u00e9diaires et leurs clients.<\/p>\n\n\n\n<p>Nos principaux commentaires sont r\u00e9sum\u00e9s ci-dessous :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Nous convenons que les commissions initiales dans les fonds distincts soul\u00e8vent des probl\u00e8mes de conflit d&rsquo;int\u00e9r\u00eats parce que le consommateur se fie aux conseils de l&rsquo;interm\u00e9diaire pour acheter un produit convenable et que l&rsquo;interm\u00e9diaire est pay\u00e9 par l&rsquo;assureur pour la vente.<\/li>\n\n\n\n<li>Nous croyons que l&rsquo;option de r\u00e9trofacturation du conseiller aggrave le probl\u00e8me de conflit d&rsquo;int\u00e9r\u00eats d\u00e9crit ci-dessus et qu&rsquo;elle devrait \u00e9galement \u00eatre interdite.<\/li>\n\n\n\n<li>Nous craignons que la communication des frais ne fournisse pas aux consommateurs les informations n\u00e9cessaires pour \u00e9valuer correctement l&rsquo;impact de tous les co\u00fbts et frais sur leurs rendements, notamment en raison de l&rsquo;absence de communication permanente sur la r\u00e9mun\u00e9ration de l&rsquo;interm\u00e9diaire.<\/li>\n<\/ul>\n\n\n\n<p>\u00c0 notre avis, les vendeurs titulaires d&rsquo;une double licence, qui vendent souvent des produits d&rsquo;assurance, pourraient \u00eatre incit\u00e9s \u00e0 vendre le produit le moins r\u00e9glement\u00e9.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Nous pensons que les principes visant \u00e0 g\u00e9rer ou \u00e0 \u00e9viter les conflits d&rsquo;int\u00e9r\u00eats devraient \u00eatre directement refl\u00e9t\u00e9s dans la l\u00e9gislation ou la r\u00e9glementation sur les assurances.<\/li>\n\n\n\n<li>Nous pensons que l&rsquo;obligation de respecter les r\u00e8gles relatives aux conflits d&rsquo;int\u00e9r\u00eats pourrait \u00eatre directement impos\u00e9e aux personnes titulaires d&rsquo;une licence, par le biais d&rsquo;un renforcement des structures et des m\u00e9canismes r\u00e9glementaires, et que des orientations suppl\u00e9mentaires pourraient \u00eatre fournies en ce qui concerne les attentes des autorit\u00e9s r\u00e9glementaires en mati\u00e8re de comparabilit\u00e9 des produits disponibles.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>T\u00e9l\u00e9charger le PDF : CCIR\/CISRO &#8211; Discussion Paper on Upfront Compensation in Segregated Funds R\u00e9sum\u00e9 de la lettre : Dans le cadre du budget 2021, le gouvernement a indiqu\u00e9 son intention de mener une consultation sur la lutte contre les pr\u00eats abusifs en abaissant le taux d&rsquo;int\u00e9r\u00eat criminel (actuellement fix\u00e9 \u00e0 60 %).
