Les modifications permettraient aux assureurs de fournir des renseignements simplifi\u00e9s aux clients s&rsquo;ils leur offrent une nouvelle option de frais d&rsquo;acquisition plus avantageuse que les frais de souscription report\u00e9s. Les modifications pr\u00e9voient quatre crit\u00e8res \u00e0 prendre en compte pour d\u00e9terminer si une option de frais d&rsquo;acquisition est meilleure qu&rsquo;un CSD et, plus pr\u00e9cis\u00e9ment, si une option de frais d&rsquo;acquisition avec r\u00e9trofacturation par le conseiller n&rsquo;est pas, sans \u00e9quivoque, meilleure qu&rsquo;un CSD. L&rsquo;information simplifi\u00e9e porterait sur la nouvelle option de frais d&rsquo;acquisition et pourrait \u00eatre fournie apr\u00e8s le changement d&rsquo;option, au lieu d&rsquo;une description d\u00e9taill\u00e9e de toutes les autres options de frais d&rsquo;acquisition disponibles avant tout changement, qui devrait \u00eatre fournie dans les cas o\u00f9 l&rsquo;option de frais d&rsquo;acquisition n&rsquo;est pas une am\u00e9lioration.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Aper\u00e7u des commentaires du Conseil :<\/h2>\n\n\n\n<p>Le Canadian Advocacy Council (CAC) a envoy\u00e9 une lettre \u00e0 l&rsquo;Autorit\u00e9 de r\u00e9gulation des services financiers de l&rsquo;Ontario (FSRA) concernant les derni\u00e8res modifications propos\u00e9es \u00e0 la Unfair or Deceptive Acts or Practices Rule (UDAP Rule). Bien que le CAC soutienne ces modifications, il craint qu&rsquo;elles n&rsquo;aillent pas assez loin dans la protection des assur\u00e9s contre les pratiques d\u00e9loyales en mati\u00e8re de frais d&rsquo;acquisition.<\/p>\n\n\n\n<p>Le CAC r\u00e9it\u00e8re son soutien \u00e0 l&rsquo;interdiction de toutes les structures de r\u00e9mun\u00e9ration initiale, y compris les r\u00e9trocessions des conseillers, dans l&rsquo;ensemble du secteur de l&rsquo;assurance et de l&rsquo;investissement. Il estime que ces structures de r\u00e9mun\u00e9ration conflictuelles devraient \u00eatre interdites de mani\u00e8re uniforme afin de garantir des normes coh\u00e9rentes et d&rsquo;\u00e9viter l&rsquo;arbitrage r\u00e9glementaire. Le Conseil souligne que les r\u00e9trocessions des conseillers posent des conflits d&rsquo;int\u00e9r\u00eats insolubles et doivent \u00eatre interdites. Il affirme que la divulgation seule est insuffisante comme outil d&rsquo;att\u00e9nuation des conflits, en particulier lorsqu&rsquo;il existe des contr\u00f4les inad\u00e9quats pour s&rsquo;assurer que l&rsquo;information est effectivement communiqu\u00e9e et comprise par les assur\u00e9s. Le CAC plaide pour que des outils de surveillance suppl\u00e9mentaires et un pouvoir r\u00e9glementaire plus large soient accord\u00e9s \u00e0 la FSRA afin de mieux traiter les conflits dans la conduite des agents et de renforcer la surveillance r\u00e9glementaire.<\/p>\n\n\n\n<p>Le CAC prend note de l&rsquo;examen en cours par les Autorit\u00e9s canadiennes en valeurs mobili\u00e8res (ACVM) et l&rsquo;Organisme canadien de r\u00e9glementation des investissements (OCRI) concernant les r\u00e9trocessions dans le secteur des fonds communs de placement, et estime que cela repr\u00e9sente une occasion unique pour les organismes de r\u00e9glementation des secteurs de l&rsquo;assurance et des valeurs mobili\u00e8res d&rsquo;aborder les conflits pos\u00e9s par ces structures de frais par le biais d&rsquo;interdictions r\u00e9glementaires.<\/p>\n\n\n\n<p>En conclusion, le CCC demande instamment \u00e0 la FSRA d&rsquo;interdire purement et simplement les r\u00e9trocessions des conseillers, en soulignant que cela permettrait de mieux aligner les agents et leurs clients, et contribuerait \u00e0 \u00e9liminer les structures de r\u00e9mun\u00e9ration qui faussent les int\u00e9r\u00eats des agents par rapport \u00e0 ceux de leurs clients.
